Lussio Terms and Conditions

These are the terms and conditions (Terms) which apply whenever you place an order with Lussio. The Terms set out our obligations to you and your rights and obligations to us., In addition, we have included key information which we are legally required to provide.

When we refer to “we”, “us” or “our”, we are referring to Lussio Limited.

When we refer to “you” or “your” we mean the person who is using this website or has bought goods from us.

1                 The Terms

·        If you buy goods on our site, you agree to be bound by these Terms.

·    We only publish our Terms in English, even if we agree to ship goods to countries with a different official language. No other languages apply to the agreement between us.

·        When buying any goods on our site you also agree to be bound by:

(a)           our Terms of Use which set out how you can use our website; our Privacy Policy which sets out how we use your personal information. and

(b)             any specific terms which we may apply to certain goods. For example, in respect of any competition, promotion or with any other brand collaboration.

 The above form a contract between us.

 

2                 Ordering from us

·        When you place your order at the end of the checkout process (eg, when you click on the [’Place Order’] button), we will acknowledge it by email. This acknowledgement does not, mean that your order has been accepted by us.

·        We may contact you to say that we do not accept your order. This may be for one of the following reasons:

(a)             the goods are out of stock or have been discontinued.

(b)             we cannot authorise your payment.

(c)             you have ordered too many goods.

(d)             there has been a mistake on the pricing or description of the goods; Or

(e)             We cannot ship to your nominated country.

·    We will only accept your order when we email you to confirm this (Confirmation Email). At this point, there is a contract, and we will dispatch the goods to you.

 

3                 Changing your mind/returns

·             You have the right to cancel your order within 14 days for any reason. The 14 days starts on the day on which the carrier delivers the goods to you. You cannot cancel your order after the cancellation period has expired.

·              To exercise the right to cancel, you must inform us of your decision to cancel by using the contact details at the top of these terms. You will need to contact us before the cancellation period has ended.

·            Where your order has been cancelled, we will reimburse the original cost of the goods provided the following apply:

The clothes are unworn, unused; and returned in the original packaging with all hang tags attached. Please note, if you, or any other person, posts a photo of you wearing the relevant clothes online, we will treat the clothes as having been worn. We will not accept a return on the basis that you have changed your mind.

·    We may make a deduction for any damage or loss in value of any goods supplied. For example, if we suspect that the clothes have been worn.

·         We will make the refund your order as soon as possible and no later than:

(a)             14 days after the day we received the return of any goods supplied; or

(b)             If cancelled before dispatch, 14 days after the day on which we are informed about your decision to cancel this contract

(c)             We will only refund delivery charges, if the product is deemed to be defective.

 

·    We will reimburse you using the same method as you paid unless we agree otherwise.

(a)             If you have received the goods: you shall send back the goods as soon as possible and not later than 14 days from the day on which you communicate your cancellation from this contract to us;

(b)              you will have to pay the cost of returning the goods to us.

 

4                 Delivery

·       We use third party carriers to deliver our goods. Delivery options can be viewed on the website www.lussio.co.uk. During the online checkout process, you will be given available delivery options to choose from.

·        Your Confirmation Email will set out the estimated date for delivery. We are not responsible for anything which is outside of our control, and which may impact or delay delivery.

·       Delivery will take place at the address specified by you when you placed your order with us.

·       Unless you and we agree otherwise, if we cannot deliver your goods within 30 days of the date of your Confirmation Email, we will:

(a)             let you know;

(b)             cancel your order; and

(c)             give you a refund.

·      You are responsible for the goods once they have been delivered to the address specified by you when you placed your order with us. In other words, the risk in the goods passes to you when you take, or a third party notified by you takes possession of the goods.

·     We currently only ship within the UK.  However, when we ship internationally, for deliveries outside of the UK, postage and shipping charges shall be as specified at checkout. Please note, that unless specified otherwise, you will be responsible for all relevant duties, taxes and tariff charges which fall due as a result of importing our goods into your preferred country. Please note, we reserve the right to cancel any order if it is to be shipped to a country we cannot confidently dispatch to.

·        We may deliver your goods in instalments if an item is temporarily out of stock.

·      Please view our shipping cost table for guidance on likely international shipping costs. We reserve the right to adjust the costs as required. We will inform you of any adjustment to the shipping cost. If you do not accept such adjusted cost, your order will be cancelled, and you will be refunded in full. Please note, free shipping above a stated order value will not apply to any international delivery.

 

5                 Payment

·       We accept the debit and credit cards listed in the checkout process. We do not accept cash or cheques.

·       We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, any failure by us to comply with this contract or our Privacy Policy (see clause 3) or breach by us of our duties under applicable laws, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.

·       Your credit card or debit card will be charged when the order for the goods is confirmed at checkout.

·        All payments by credit card or debit card need to be authorised by the relevant card issuer.

·      All prices are in pounds sterling (£) (GBP) and include VAT at the applicable rate, but exclude delivery charges. Delivery options and related shipping costs can be viewed at checkout and in the shipping costs tabs on the website.

 

6                 Defective goods

·        Your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’) are set out at the top of this page. They are a summary of some of your key rights. For more detailed information on your rights and what you should expect from us, please:

(a)             contact us using the contact details at the top of this page; or

(b)       visit the Citizens Advice website www.citizensadvice.org.uk or call 0808 223 1133.

· Nothing in this contract affects your legal rights under the Consumer Rights Act 2015 (also known as ‘statutory rights’). You may also have other rights in law.

·      If your goods are faulty, please contact us using the contact details at the top of this page.

 

7                 End of the contract

If this contract is ended, it will not affect our right to receive any money which you owe to us under this contract.

 

8                 Limitation on our liability

·    Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:

(a)          losses that were not foreseeable to you and us when the contract   was formed;

(b)             losses that were not caused by any breach on our part;

(c)             business losses; or

(d)             losses to non-consumers.

 

9                 Third party rights

No one other than a party to this contract has any right to enforce any term of this contract.

 

10              Disputes and complaints

·     We will try to resolve any complaints or disputes with you quickly and efficiently. If you are unhappy with the goods you ordered, please contact us as soon as possible using the contact details set out at the top of this page.

·   These Terms are subject to English law and to the exclusive jurisdiction of the courts of England & Wales.
